The rules that apply when you browse, register or purchase from the UPENDS South Africa website.
1. Website Operator
This website is operated by Revald Holdings Limited for the UPENDS brand.
2. Eligibility and Age Restriction
You must be at least 18 years old to access age-restricted product areas or purchase products. We may request proof of age or identity.
Products are intended only for adults of legal smoking age and not for children, non-smokers, pregnant or breastfeeding persons, or persons for whom nicotine use may present a health risk.
3. Product Information and Use
We aim to display descriptions, images, colours, specifications and availability accurately. Minor differences may occur due to screens, packaging revisions or production batches.
Puff counts and performance figures are estimates under stated test conditions. Actual results vary with puff duration, power mode, airflow, storage and individual usage.
4. Orders and Acceptance
- An order is an offer to purchase and does not guarantee acceptance.
- Orders are subject to payment, stock, age checks and fraud review.
- We may verify order or delivery information.
- We may cancel orders affected by suspected fraud, stock error, pricing error or legal restriction.
5. Prices and Currency
Unless stated otherwise, prices are in South African Rand (ZAR). Delivery charges and applicable taxes are shown before submission.
6. Payment
Payment may include Visa, Mastercard, Diners Club, American Express and electronic bank transfer where shown at checkout. Orders dispatch only after funds are authorised or cleared. Full card details are processed by the checkout payment provider and not stored by this website.
7. Shipping and Delivery
Standard online delivery is available within South Africa. Orders are processed during business hours Monday to Friday, excluding public holidays. Delivery dates are estimates. Customers are responsible for accurate delivery information and costs caused by incorrect addresses, failed delivery or uncollected parcels.
8. Returns, Defects and Refunds
Returns require prior written approval. Unused eligible goods may be requested for return within the period stated in our Returns & Refunds Policy. Opened or used hygiene-sensitive products are generally not eligible for change-of-mind returns. Mandatory remedies for defective, unsafe, damaged or incorrectly supplied goods remain unaffected.
9. Cancellation
Contact us immediately to request cancellation. Cancellation is not guaranteed after processing or dispatch. Where legally permitted, an approved customer-requested cancellation may incur an administration fee of up to 20%, excluding mandatory cooling-off or consumer rights.
10. Health and Nicotine Disclaimer
Nicotine is addictive. Products are not medicines and are not intended to diagnose, treat, cure or prevent disease or to serve as smoking-cessation treatment. Keep products away from children and animals.
11. Battery and Charging Safety
- Use a suitable cable and power source.
- Do not charge unattended, near water or on a flammable surface.
- Stop use if a product is swollen, leaking, unusually hot or damaged.
- Do not modify, puncture, crush or expose a battery to extreme temperatures.
12. Limitation of Liability
To the extent permitted by law, we are not liable for indirect loss arising from misuse, modification, failure to follow instructions, incorrect storage or events outside our reasonable control. Liability that cannot legally be excluded remains unaffected.
13. Intellectual Property
Website content, trademarks, logos, product images, graphics, text and designs are owned by or licensed to UPENDS or the operator and may not be used commercially without permission.
14. Acceptable Website Use
You may not interfere with security, attempt unauthorised access, upload malicious code, impersonate others, submit unlawful content or use the website for fraud or abuse.
15. Third-Party Services and Links
Payment, delivery, analytics and other functions may be provided by third parties with their own terms and privacy practices.
16. Force Majeure
We are not responsible for delay or failure caused by natural disaster, severe weather, strike, transport disruption, system outage, customs action, government restriction, epidemic or supplier interruption.
17. Governing Law
These Terms are governed by laws applicable in South Africa, subject to mandatory rights or rules that apply to the operator or customer. Disputes should first be submitted to support for good-faith resolution.
18. Changes to These Terms
We may update these Terms when services, practices or legal obligations change. The published version applies except where law requires otherwise.
